Terms of Use

These Terms of Use ("Terms" or "EULA") form a binding agreement between you and HomeCombat ("we", "us") and govern your use of the HomeCombat mobile application ("the app"). By downloading or using the app you agree to these Terms. If you do not agree, please do not use the app. These Terms are the End User License Agreement for the app and, where the app is distributed through the Apple App Store, they replace Apple's standard EULA.

1. Health & safety disclaimer

HomeCombat provides combat-sports training content for general fitness and educational purposes only. It is not medical advice. Combat training is physically demanding and carries an inherent risk of injury.

• Consult a physician before starting this or any exercise program, especially if you have a health condition or injury.
• Train within your own limits, warm up properly, and stop if you feel pain, dizziness or discomfort.
• Ensure you have a safe, clear space to train.
• You use the app and perform all exercises at your own risk.

2. Your account

You are responsible for keeping your account credentials secure and for activity that occurs under your account. You must provide accurate information and be at least 13 years old (or the minimum digital-consent age in your country) to create an account.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial training. You may not copy, resell, reverse-engineer, or redistribute the app or its content.

4. Subscriptions, free trial & billing

HomeCombat offers an auto-renewing subscription called HomeCombat Premium, available in two plan lengths. Some combos and coaching voices are free; full access requires a subscription.

• Plan lengths and prices. Monthly (1 month) at $4.99 USD per month, or Yearly (1 year) at $49.99 USD per year. Prices in other regions are shown in the app before purchase and may vary by region and currency.
• Free trial. New subscribers start with a 3-day free trial. You will not be charged during the trial.
• Billing. Unless you cancel at least 24 hours before the trial ends, your subscription begins and the plan price is charged to your Apple ID. It then renews automatically at the end of each period (each month or each year, matching your selected plan) at the then-current price, until cancelled.
• Cancellation. You can cancel anytime in your device's App Store subscription settings (Settings > [your name] > Subscriptions on iOS). Cancelling before the trial ends means you pay nothing. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• Payments. Payments are processed by Apple; we do not handle your payment details.

5. Cancelling vs. deleting your account

Cancelling your subscription stops future billing but keeps your account. To permanently erase your account and all training data, use Profile → Delete Account in the app. Account deletion does not by itself cancel an active App Store subscription — cancel that separately in your App Store settings.

6. Acceptable use

You agree not to misuse the app, including not attempting to disrupt the service, access it through unauthorized means, or use it for any unlawful purpose.

7. Intellectual property

The app, its combos, audio, branding and design are owned by HomeCombat and protected by intellectual-property laws. All rights not expressly granted to you are reserved.

8. Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that it will achieve any particular fitness result.

9. Limitation of liability

To the maximum extent permitted by law, HomeCombat and its team will not be liable for any indirect, incidental, or consequential damages, or for any injury arising from your use of the app or performance of any exercise.

10. App Store terms (Apple)

The following apply when you obtain or use the app through the Apple App Store. You acknowledge and agree that:

• Parties. These Terms are an agreement between you and HomeCombat only, and not with Apple. Apple is not responsible for the app or its content.
• Scope of licence. The licence granted to you in Section 3 is limited to a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms.
• Maintenance and support. HomeCombat is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services for the app.
• Warranty. HomeCombat is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app.
• Product claims. HomeCombat, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, HomeCombat, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. Any questions, complaints or claims about the app should be directed to khoa@homecombat.com.
• Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the app after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of your country of residence, except where mandatory consumer-protection law of your jurisdiction requires otherwise. Nothing in these Terms limits your statutory consumer rights.
